Address Service - Terms And Conditions
To register for this service, you
must accept the terms and conditions as set out below.
1. The Web Address service is provided
by AAA Publishing Group Pty Ltd for use by you ("the User") under the terms
and conditions outlined. Completion of the Registration Process for the Web Address
service indicates that you have accepted all the terms and conditions presented.
2. AAA Publishing Group Pty Ltd reserves
the right to terminate any "User's" account if supplied registration details
are found to be misleading or false.
3. AAA Publishing Group Pty Ltd may
modify the Terms and Conditions from time to time to meet changing needs. AAA Publishing
Group Pty Ltd does not have to provide "User's" with any notice of impending
changes although where possible an email may be issued. Continued use of the redirection
service will be deemed as acceptance of any future changes.
4. Operation of the AAA Publishing
Group Pty Ltd redirection service may be modified of discontinued without notice
to any "User's" without liability to any "User" or any third
party "User"
5. Net Abuse. AAA Publishing Group
Pty Ltd reserves the right to remove any "User" without any warning if
abuse of the redirection service occurs. Anything which is deemed illegal or detracts
from the redirection service will be considered abuse. AAA Publishing Group Pty Ltd
does not tolerate SPAM in any form which includes unsolicited email, newsgroups etc.
By abusing the service in anyway, the "User" will be removed and possible
legal action may be implemented.
6. Web Contents or promotional materials.
AAA Publishing Group Pty Ltd does not and cannot censor, monitor or edit any of the
"User's" web content. The "User" is totally responsible for all
content whether it be web based or message based. "User's" must also agree
not to use the AAA Publishing Group Pty Ltd redirection service for "Spamming",
junk mail, chain letter's or for any purpose for which "User's" have not
been given verifiable permission. "User's" also accept that material which
is considered abusive, threatening, harmful, obscene, unlawful, libellous, harassing
or anything which might be considered objectionable or promotes activities that might
be constituted as a criminal offence or leads to civil liabilities or similar that
could break international, national, state or local laws or regulations. In such
circumstances AAA Publishing Group Pty Ltd reserves the right to Terminate a "User's"
account if any of the previous areas have been deemed to have occurred.
7. The use of TRADEMARKS is at the
"User's" risk. AAA Publishing Group Pty Ltd does not monitored nor examine
"User" names. A "User's" account may be terminated without notice
should the rightful TRADEMARK holder place such a request.
8. Restrictions are placed on "User's"
to ensure the AAA Publishing Group Pty Ltd redirection service remains functional
and accessible. There are no restrictions on the number of subdomain names held by
"User's" although each URL site is restricted to one subdomain. In addition,
subdomains must be accessed at least once every 30 days to ensure continued function.
After that, it will be terminated. Restrictions outlined above are to prevent potential
abuse of the AAA Publishing Group Pty Ltd redirection service by subdomain name hoarders.
9. Acceptance of a "User"
does not mean endorsement by AAA Publishing Group Pty Ltd redirection service. The
presentation and content of a "User's" site is entirely the responsibility
of the "User".
10. As a "User" of the
AAA Publishing Group Pty Ltd redirection service you will be issued with a PASSWORD
associated with a "Users" account. It will be the "User's" responsibility
to ensure the confidentiality of issued Passwords and Account details. A "User"
is also entirely responsible for all activities which occur under the established
Account. AAA Publishing Group Pty Ltd redirection service also requires the reporting
of unauthorised usage of "User's" accounts or security issues.
11. Disclaimer. "Users"
expressly agree that by using the AAA Publishing Group Pty Ltd redirection service
is done at their own risk. The redirection service is supplied as is and as available.
AAA Publishing Group Pty Ltd expressly disclaim all warranties of any kind, express
or implied which includes without limitations any warranty of merchantability, fitness
for a particular purpose or non-infringement. AAA Publishing Group Pty Ltd redirection
service makes no warranties that the redirection service will meet a "User's"
requirements or that the AAA Publishing Group Pty Ltd redirection service will be
interrupted, timely, secure or error free. AAA Publishing Group Pty Ltd redirection
service does not make any warranties as to the results that may be obtained from
the use of the redirection service or any information obtained from such. "User's"
agree that any material and/or data downloaded or otherwise obtained through the
use of AAA Publishing Group Pty Ltd redirection is at the "User's" own
discretion and risk. "User's" are totally responsible for any damage which
may be suffered.
12. "User's" are not permitted
to resell any subdomains. "User's" are restricted to personal use only.
"User's" must have express consent before resale may take place. Failure
to do so will lead to termination of the "User's" account.
13. Liability. AAA Publishing Group
Pty Ltd redirection service will not be liable for any direct or indirect, incidental,
special or consequential damages which may arise from the use or the inability to
use the AAA Publishing Group Pty Ltd redirection service or for the cost of procurement
or substitute goods and services or resulting from any goods or services purchased
or obtained or messages received or transactions entered into through the AAA Publishing
Group Pty Ltd service or resulting from unauthorised access to or alteration of "User's"
transmission or data, including but not limited to damages for loss of revenue, use,
data or other intangible, even if AAA Publishing Group Pty Ltd redirection service
has been advised of the possibility of such damages.
14. Limitations. AAA Publishing Group
Pty Ltd redirection service accepts no responsibility for the failure of redirect
requests for uniform resource locators. Furthermore AAA Publishing Group Pty Ltd
redirection places no maximum limited on the number of redirects a "User"
may receive by using the service, however AAA Publishing Group Pty Ltd reserves the
right at its own discretion to determine if a "User's" conduct is in keeping
within the normal usage expected of such a service. A "User's" account
may be terminated if deemed to be outside acceptable usage levels.
15. AAA Publishing Group Pty Ltd
redirection service does not offer web site storage or email facilities. As a consequence,
"User's" are therefore responsible for any technical problems arising from
the deletion, loss of function or failure of mentioned facilities.
16. Indemnification. "User's"
agree to indemnify and hold AAA Publishing Group Pty Ltd redirection services and
subsidiaries, employees, associates harmless from any demand or claim which includes
legal fees made by any third party arising out of a "User's" use of the
AAA Publishing Group Pty Ltd redirection service, the violation of the Terms and
Conditions or the infringement by "User's" or other user's of the redirection
service or using a "User's" computer, of any intellectual property or other
right of any person or entity.
17. Termination. Either the "User"
or AAA Publishing Group Pty Ltd redirection may terminate the provided redirection
service without cause at any time and effective immediately. The termination process
will be via an email notice outlining the process. AAA Publishing Group Pty Ltd redirection
will not be liable to "User's" or any associated third party for the termination
of this service.
